KVKK – CUSTOMER/INVITEE CLARIFICATION TEXT

Pursuant to the Procedures and Principles of the Law No. 6698 on the Protection of Personal Data (“KVKK”) which entered into force on April 7, 2016; we hereby notify you that the personal data you have shared with “infofair.com.tr” may be stored, recorded, preserved, rearranged, shared with institutions authorized by law to request such personal data, and transferred to third parties domestically or abroad, assigned, classified, and processed in other ways listed in the KVKK, under the conditions envisaged by the KVKK, within the scope and duration of the purpose requiring their processing, within the scope of our commercial relations or our business relations with you, in a manner connected with this purpose, limited and proportionate, by preserving the accuracy of the shared personal data and keeping it up to date as notified to us. The purpose of this Customer Clarification Text is to provide detailed information regarding the processing of personal data obtained from the members, users, and/or visitors (“Customer”, “Invitee”) of the website, which is publicly operated by infofair.com.tr and has a link address, during the operation of the said site.

PROCESSED PERSONAL DATA

Your personal data that may be processed as a Customer/Invitee to date and/or in future processes are as follows; Your name and surname, which are evaluated in the identity data category, will be processed via the “Fair Application Form” and “E-Invitation Form” tabs filled out within the scope of your www.infofair.com.tr website membership; for the purpose of ensuring your distinguishability, creating an e-invitation for the fair on your behalf, and receiving your application for the relevant fair. Your contact information, evaluated in the contact data category, specifically your e-mail address, phone information, and address, will be processed to prevent multiple registrations with the same e-mail address in our system, to reach you if necessary to communicate regarding the fair you applied for/requested an invitation for, to communicate with you regarding your application, to deliver your fair invitation to you, to ensure you are informed about the products and services offered, and to send advertising and promotional content via e-mail and phone, provided that you give consent for sending commercial electronic messages to you. The information regarding the firm you work for/planned area given in the fair application form via the www.infofair.com.tr website will be processed for the purpose of obtaining preliminary information necessary for the fair space to be rented to you.

PROCESSING PURPOSES

Your personal data may be processed by the Company for the following purposes and reasons. In particular, to provide the legitimate interests of the Company; your personal data will be processed for the purposes listed below:

  • For the purpose of offering products and services and establishing communication regarding the products and services you have received/will receive,
  • For the purpose of fulfilling the contracts,
  • For the purpose of issuing invoices pursuant to current legislation and ensuring that you can fully and properly exercise your rights arising from current legislation,
  • For the purpose of evaluating customer complaints and suggestions regarding our services,
  • For the purpose of improving, developing, and diversifying our services and offering or informing real/legal persons with whom we are in a commercial relationship,
  • For the purpose of planning the scopes of fairs in accordance with participant and visitor expectations, monitoring the activity, and ensuring its continuity,
  • For the purpose of increasing the awareness of fairs by participants, visitors, the press, relevant non-governmental organizations, and relevant public institutions and organizations,
  • For the purpose of creating databases regarding customers, fair participants, and/or fair visitors, continuing marketing activities, getting to know our customers, fair participants, and visitors, increasing mutual communication, conducting data analysis and research, and increasing service quality,
  • For the purpose of improving and enhancing customer data quality, designing and managing loyalty actions for customer management, cross-selling, and actions to regain lost customers,
  • For the purpose of determining and implementing the commercial and business strategies of İnfo Fuarcılık,
  • For the purpose of preparing all necessary records and documents for you to complete your transactions in written, verbal, or electronic environments,
  • For the purpose of transmitting important information we need to share with you via your contact information,
  • For the purpose of fulfilling activities related to services offered to you through contracted institutions,
  • For the purpose of ensuring the legal or technical security of persons in a business relationship and ensuring business continuity,
  • For the purpose of conducting necessary quality and standard audits or fulfilling our reporting and other obligations determined by laws and regulations,
  • For the purpose of fulfilling legal obligations stated in the KVKK and exercising our rights arising from legislation, to the extent required or compelled by legal regulations, with regulatory and supervisory institutions.

Additionally, your personal data may be processed for the purpose of sending information via SMS and/or e-mail regarding promotion and marketing activities of İnfo Fuarcılık’s services by the organizations we cooperate with for the promotion and marketing of the services we offer and the commercial electronic message intermediary service provider we have an agreement with, to your contact addresses that have been processed or are currently being processed by them. (Your consent will be obtained regarding the subject if legally required.) It will be processed for specific, explicit, and legitimate purposes within the scope of personal data processing conditions and purposes stated in the 5th and 6th articles of the Law. Your personal data will be preserved for the maximum period specified in the relevant legislation or required for the purpose for which they are processed, and in any case, for the legal statute of limitations periods.

SHARING OF CUSTOMER/INVITEE DATA WITH THIRD PARTIES

İnfo Fuarcılık transfers your personal data to third parties only in line with the purposes stated in this Clarification Text and in accordance with Articles 8 and 9 of the KVKK. Your personal data may be transferred within the framework of the conditions envisaged in the KVKK; to domestic and foreign partnerships or subsidiaries for the execution and continuity of commercial activities, to domestic-foreign third parties to whom support services are provided or from whom support services are received, to service providers supporting us in data processing activities, to audit firms within the scope of contracts for the purpose of auditing commercial activities pursuant to relevant legislation provisions, to legally authorized public institutions and organizations to a limited extent within the scope of requests under the legal authority of relevant public institutions and organizations, to determined public institutions and organizations to ensure the fulfillment of legal obligations specified in the KVKK, and to commercial electronic message intermediary service providers for the purpose of making promotion and advertising.

SECURITY, PRESERVATION, AND DESTRUCTION OF YOUR PERSONAL DATA

İnfo Fuarcılık has high sensitivity and awareness regarding personal data security and the protection of individual privacy. As İnfo Fuarcılık, we take the necessary administrative and technical measures to ensure protection against unauthorized access to personal data or the loss, erroneous use, disclosure, alteration, or destruction of this information, and to keep personal data confidential, ensure confidentiality, and provide security. In necessary cases, İnfo Fuarcılık immediately informs you and the Personal Data Protection Board in accordance with the Law and personal data protection legislation. The personal data of our Customers/Invitees specified in this Customer Clarification Text are processed by İnfo Fuarcılık by ensuring their security in accordance with the Personal Data Protection Procedure and the Personal Data Storage and Destruction Policy, primarily the Law and personal data protection legislation. Your personal data are preserved for the period necessary for the processing purposes stated in this Customer Clarification Text and in any case during the legal statute of limitation periods specified in legal regulations. Upon the expiration of said periods or if your request in this direction is found appropriate, İnfo Fuarcılık deletes, destroys, or anonymizes your personal data in accordance with the Personal Data Storage and Destruction Policy.

YOUR RIGHTS UNDER ARTICLE 11 OF THE KVKK

Pursuant to Article 11 of the KVKK, provided you prove your identity, regarding your personal data; You have the right to learn whether the Company processes personal data about you, and if so, to request information about this, to learn the purpose of processing personal data and whether they are used in accordance with the purpose, and to learn whether personal data are transferred domestically or abroad and to whom. Additionally, you have the right to request the correction of your incorrect and incomplete personal data by İnfo Fuarcılık and the notification of recipients to whom your data has been or may be transferred. You may request the deletion and destruction of your data within the framework of the conditions stipulated in Article 7 of the KVKK from İnfo Fuarcılık. At the same time, you may request the notification of third parties to whom the data has been or can be transferred regarding such deletion and destruction. You may object to the results of the analysis of your personal data created exclusively using an automated system if they are against your interests. In case you suffer damage due to the unlawful processing of your personal data, you may request the remedy of the damage. Your requests stated in your application will be concluded free of charge within thirty days at the latest, depending on the nature of the request. However, if the process requires a separate cost for the Company, a fee may be charged in the manner determined in the Communiqué on Application Procedures and Principles to the Data Controller by the Personal Data Protection Board. For matters regarding the processing of your personal data, you need to fill out the application form found on the Company’s website and deliver it to our company as stated in the form.

EXCEPTIONS TO THE RIGHT OF APPLICATION

Pursuant to Article 28 of the Personal Data Protection Law, data subjects will not be able to assert their rights on the following issues:

  • Processing of personal data for research, planning, and statistical purposes by anonymizing them with official statistics.
  • Processing of personal data for artistic, historical, literary, or scientific purposes or within the scope of freedom of expression, provided they do not violate national defense, national security, public safety, public order, economic security, privacy of private life, or personality rights or constitute a crime.
  • Processing of personal data within the scope of preventive, protective, and intelligence activities carried out by public institutions and organizations authorized and assigned by law to ensure national defense, national security, public safety, public order, and economic security.
  • Processing of personal data by judicial authorities or execution offices regarding investigation, prosecution, trial, or execution proceedings.

Pursuant to the second paragraph of Article 28 of the PDP Law; except for requesting the remedy of damages in the cases listed below, data subjects will not be able to assert their rights:

  • Personal data processing is necessary for the prevention of crime or criminal investigation.
  • Processing of personal data that has been made public by the data subject themselves.
  • Personal data processing is necessary for the execution of audit or regulation duties and disciplinary investigation and prosecution by public institutions and organizations authorized and assigned by law or public professional institutions with public institution status.
  • Personal data processing is necessary for the protection of the economic and financial interests of the state regarding budget, taxation, and financial matters.
